The Valencia City Council has requested a report from the Legal Advisory on the works at number 6 Encarna Albarracín street, following complaints from residents regarding the opening of a window.
The Valencia Urban Planning councillor, Juan Giner, signed a motion on Wednesday to request a discretionary report from the municipal Legal Advisory to determine whether the City Council can intervene in the works being carried out at 6 Encarna Albarracín street, as reported by the council.
This request comes after several residents filed complaints requesting the suspension of the works, which have a license and a change of use to hotel tertiary. The Municipal Inspection Service visited the property on August 14 and issued a report on August 17 concluding that, based on observable evidence, the works basically comply with the project.
The residents' complaint focuses on the opening of spaces for windows that overlook a common area of the residential building. According to the inspection, that window is included in the modified project and, during the visit, it was confirmed that the construction company, in agreement with the owner and the technical management, has adopted a solution with translucent vinyl and minimal opening to balance lighting, ventilation, and privacy.
However, the homeowners' association argues that the community statutes prohibit such openings over common elements. Therefore, the council has decided to seek legal advice to determine whether a potential violation of those statutes allows the City Council to suspend works that have administrative approval and are currently underway.
Councillor Juan Giner concluded that the City Council is following the entire administrative process, addressing the complaints, gathering the necessary technical and legal reports, and acting diligently to provide a response with all guarantees, without neglecting the concerns raised by the residents.
While the legal report is being resolved, the works continue as planned. Affected residents will be able to know the ruling once the Legal Advisory issues it, a process that could take several weeks.
